These Terms of Service ("Terms") govern your access to and use of the WordCount AI website and services (collectively, the "Service"), located at www.wordcountai.com. Please read these Terms carefully before using the Service.

By accessing or using WordCount AI, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

1. Description of Service

WordCount AI provides a free online tool for analyzing text content. Our Service includes features such as word counting, character counting, sentence and paragraph counting, reading time estimation, AI-powered readability analysis, and other advanced text metrics ("Analysis Results"). The Service is provided free of charge and supported by advertising.

2. Use of the Service

You agree to use WordCount AI only for lawful purposes and in a manner consistent with these Terms and all applicable laws and regulations. You are solely responsible for the text content you input into the Service ("User Content").

Prohibited Uses:

• You must not input User Content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• You must not use the Service in any way that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service.
• You must not attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service.
• You must not use the Service to infringe upon the intellectual property rights or other rights of any third party.
• You must not use automated scripts, bots, or other means to access or interact with the Service in a way that places an excessive load on our systems, unless explicitly permitted by us.

WordCount AI provides a "Report Content" feature. If you analyze content using our tool that you believe violates these Terms or is otherwise inappropriate (e.g., offensive, illegal), you may use this feature. Reporting content helps us maintain a safe environment, but please note that we do not store the reported text itself, as explained in our Privacy Policy. We review reports but do not guarantee specific actions based on them.

4. Intellectual Property

The Service, including its design, text, graphics, logos, icons, images, software, and the Analysis Results generated (excluding your User Content), are the property of WordCount AI or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes, subject to these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as necessary for your use of the Service.

You retain ownership of your User Content. By submitting User Content to the Service, you grant us a temporary, worldwide, non-exclusive, royalty-free license to use, process, and transmit your User Content solely for the purpose of providing the Service and generating the Analysis Results for you. This license terminates immediately once the analysis is complete and the content is discarded.

5. AI Analysis Disclaimer

The advanced metrics, readability scores, and other AI-powered Analysis Results provided by WordCount AI utilize complex language models. While we strive for accuracy and usefulness, these analyses are provided "as is" for informational purposes only. They should be considered estimates and guidelines, not definitive professional advice.

The interpretation and accuracy of AI analysis can be influenced by factors like language nuances, context, writing style, and the inherent limitations of the AI models. We do not guarantee the absolute correctness, completeness, or suitability of the AI-generated results for any specific purpose. You should always apply your own judgment when interpreting and using the Analysis Results.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WORDCOUNT AI DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF THE ANALYSIS RESULTS OR ANY OTHER INFORMATION PROVIDED THROUGH THE SERVICE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WORDCOUNT AI, ITS AFFILIATES, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING THE ANALYSIS RESULTS; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT, IF ANY, PAID BY YOU TO US FOR USE OF THE SERVICE OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

8. Indemnification

You agree to defend, indemnify, and hold harmless WordCount AI, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content.

9. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make changes, we will update the "Last Updated" date at the beginning of these Terms. Your continued use of WordCount AI after any such changes constitutes your acceptance of the new Terms. We encourage you to review the Terms periodically for any updates.

10. Governing Law and Jurisdiction
